By accessing or using Artberry, you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the Platform.

Artberry is an online marketplace that connects artists, performers, creative professionals, organizations, event companies, businesses, and individuals.

Artberry only facilitates introductions and communication between users. Artberry is not a party to any agreement, booking, transaction, or engagement entered into between users.

You must be at least 18 years old to create and use an account.

By using Artberry, you represent that:

• You are legally capable of entering into binding agreements.
• All information provided by you is accurate and complete.
• You will comply with all applicable laws and regulations.

Users may register using mobile number verification or any other methods made available by Artberry.

You are solely responsible for:

• Maintaining confidentiality of your account.
• All activities conducted through your account.
• Updating your profile information when necessary.

Artberry reserves the right to suspend or terminate accounts that provide false, misleading, fraudulent, or incomplete information.

Users may upload profile photographs, portfolios, descriptions, videos, documents, job postings, and other content.

You represent and warrant that:

• You own or have permission to use all uploaded content.
• Your content does not infringe intellectual property rights of others.
• Your content is lawful, accurate, and not misleading.

Artberry reserves the right to remove any content without prior notice if it violates these Terms.

Artberry is solely a technology platform.

Artberry:

• Does not employ artists.
• Does not employ organizations.
• Does not guarantee bookings.
• Does not guarantee work opportunities.
• Does not guarantee income or business outcomes.
• Does not verify the quality, legality, safety, suitability, identity, qualifications, or reliability of any user.

Users are solely responsible for independently evaluating and verifying each other before entering into any engagement.

Bookings made through Artberry represent expressions of interest and communication between users.

Users acknowledge that:

• Artberry is not a party to any agreement between users.
• Users are solely responsible for negotiating terms.
• Users are solely responsible for pricing, deliverables, schedules, cancellations, contracts, and performance obligations.

At present, Artberry does not process or facilitate payments.

Any payment, advance, refund, cancellation fee, or financial arrangement is solely between users.

Artberry shall not be responsible for:

• Payment disputes.
• Non-payment.
• Delayed payments.
• Fraudulent payments.
• Refund claims.
• Financial losses.

Users agree not to:

• Post false, misleading, or fraudulent information.
• Impersonate another person or entity.
• Harass, threaten, abuse, or defame others.
• Upload obscene, illegal, hateful, discriminatory, or offensive content.
• Violate intellectual property rights.
• Use automated tools, bots, scraping tools, or unauthorized access methods.
• Circumvent platform restrictions.
• Engage in illegal activities.

Mobile verification does not constitute identity verification.

Artberry does not guarantee that any user is genuine, qualified, trustworthy, or suitable.

Users should independently conduct due diligence before entering into any engagement.

Users agree to exercise caution when meeting individuals offline.

Artberry shall not be liable for:

• Personal injury.
• Death.
• Property damage.
• Theft.
• Misconduct.
• Criminal activity.
• Harassment.
• Any incidents occurring during or after interactions between users.

All Artberry trademarks, logos, software, designs, content, and technology are owned by Artberry.

Users may not copy, reproduce, modify, distribute, or exploit any part of the Platform without written permission.

By uploading content to Artberry, you grant Artberry a worldwide, royalty-free, non-exclusive license to host, store, display, reproduce, distribute, and promote such content for operating, marketing, and improving the Platform.

Artberry may suspend or terminate any account at any time, without prior notice, if:

• These Terms are violated.
• Fraudulent activity is suspected.
• Illegal conduct is detected.
• User behavior harms the Platform or other users.

To the maximum extent permitted by law, Artberry and its owners, directors, employees, and affiliates shall not be liable for:

• Direct or indirect damages.
• Loss of income.
• Loss of business.
• Loss of reputation.
• Loss of data.
• Service interruptions.
• User disputes.
• Fraud committed by users.
• Any consequential or incidental damages.

Your use of the Platform is entirely at your own risk.

You agree to indemnify and hold harmless Artberry and its owners from any claims, losses, liabilities, damages, expenses, or legal costs arising from:

• Your use of the Platform.
• Your violation of these Terms.
• Your interactions with other users.
• Any disputes between users.

Artberry reserves the right to modify these Terms at any time. Continued use of the Platform after modifications constitutes acceptance of revised Terms.

These Terms shall be governed by the laws of India.

Courts located in Pune, Maharashtra, India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms.
